WHAT IS A MIAM?

A MIAM is usually the first step before mediation and is normally required before making certain family court applications about children or finances, unless an exemption applies.

 

It gives you the opportunity to understand your options, discuss whether mediation may be suitable and decide what to do next.

What is a MIAM?

A MIAM (Mediation Information and Assessment Meeting) is an individual meeting with a family mediator. It gives you the opportunity to learn about mediation, discuss your situation and explore whether mediation is suitable for you and your family.

How long does a MIAM take?

A MIAM typically lasts around 45 minutes, giving you plenty of time to discuss your circumstances and ask questions.

What happens after the MIAM?

If mediation is suitable and everyone agrees to take part, we can arrange mediation sessions. If mediation is not suitable or does not go ahead, your mediator will explain the possible next steps and, where appropriate, sign the relevant section of the court application form.

Can I attend a MIAM online?

Yes. We offer MIAMs online via secure video appointment, as well as face-to-face at our North East offices.

Will the mediator take sides?

No. Family mediators are impartial. Their role is to help you understand your options and, if mediation proceeds, facilitate constructive discussions. They don't take sides or make decisions for you.

Do we attend the MIAM together?

No. MIAMs are usually held separately, so you'll have your own confidential meeting with the mediator before the other person is invited to attend their MIAM.

Is attending a MIAM compulsory?

If you're making certain applications to the Family Court, you'll usually need to attend a MIAM unless an exemption applies, such as domestic abuse or urgency. Even if court isn't being considered, many people choose to attend a MIAM to understand their options.

Can I get Legal Aid for a MIAM?

Yes. If you or the other person qualifies for Legal Aid, you may not have to pay for your MIAM. If only one person qualifies, Legal Aid can also cover the first mediation session for both people. We will assess eligibility and explain what funding applies.

What should I bring to my MIAM?

You don't need to prepare anything special. If your case involves finances, it can be helpful to have a general understanding of your financial situation. We'll explain everything you need during the meeting.

How much does a MIAM cost?

Our current private MIAM fee is £140 online or £150 face-to-face. If you're eligible for Legal Aid, your MIAM may be free of charge.
