WHAT IS DOMESTIC ABUSE?

Domestic abuse refers to a pattern of behaviour intended to control, intimidate, or harm another person. It can take many forms, including:

  • Physical abuse: Acts of violence or physical harm.

  • Emotional and psychological abuse: Manipulation, intimidation, or threats that impact mental health.

  • Financial abuse: Controlling or limiting access to money and resources.

  • Coercive control: A pattern of controlling behaviour that removes a person’s independence.

 

At Pax Mediation, we take all forms of domestic abuse seriously and follow strict safeguarding procedures to ensure the safety of all clients.

HOW MEDIATION ADDRESSES DOMESTIC ABUSE CONCERNS

Mediation is not always suitable in cases of domestic abuse. However, if deemed appropriate, specific measures are taken to ensure a safe and constructive process:

1. Initial Safeguarding Assessment

During the Mediation Information and Assessment Meeting (MIAM), our mediators conduct a thorough assessment to assess whether mediation is suitable.

  • If domestic abuse is identified, we may recommend alternative pathways, such as legal or support services.

  • Mediation will only proceed if both parties feel safe and appropriate measures are in place.

 

2. Separate Sessions (Shuttle Mediation)

In cases where mediation is suitable, if needed we can arrange shuttle mediation, where both parties are in separate rooms or attend sessions online. This ensures no direct contact between participants.

 

3. Confidentiality and Safety

Mediation discussions are confidential unless there is a risk of harm to a person or child, in which case appropriate authorities will be informed.

 

4. Tailored Support and Referrals

Our mediators can provide referrals to trusted domestic abuse support services, legal aid, or counselling to ensure you have the help you need.

WHEN MEDIATION MAY NOT BE SUITABLE

Mediation may not be appropriate if:

​

  • There is an ongoing risk of harm to a party or child.

  • Either party feels unsafe participating in the process.

  • A power imbalance makes fair and open discussions impossible.

 

In such cases, we will guide you toward alternative resources, such as legal aid, social services, or domestic abuse organisations.
