About Child Inclusive Mediation.
FREQUENTLY ASKED QUESTIONS
If you're considering Child Inclusive Mediation, it's natural to have questions.
Below are answers to some of the questions we are most commonly asked by parents, solicitors and family professionals.
Does My Child Have To Attend Child Inclusive Mediation?
No. Child Inclusive Mediation is entirely voluntary for children and young people. Even if both parents agree that Child Inclusive Mediation may be helpful, the child must also be willing to take part. Children are free to decide whether they would like to meet with the mediator and can change their mind at any stage. No child is ever forced to participate.
Is Child Inclusive Mediation Confidential?
Yes. Children are given a confidential space to talk with a specially trained mediator. Before any information is shared with parents, the mediator will discuss this with the child and agree what can be passed on. The main exception is where there are safeguarding concerns or concerns about a child's safety or wellbeing. The mediator will explain confidentiality carefully before any meeting takes place.
What If My Child Refuses To Take Part?
That is completely okay. Participation is always voluntary. Some children are keen to share their views, while others prefer not to take part. A child's decision will be respected. The mediator may explore whether there are concerns or worries about the process, but no child will be pressured into participating. Parents can still continue with mediation even if their child chooses not to attend.
What Age Can Children Attend Mediation?
There is no fixed minimum age. In most cases, Child Inclusive Mediation is offered to children aged 10 and above, although every child is different.
The mediator will consider:
-
The child's age
-
Their level of understanding
-
Their confidence in communicating their views
-
Whether participation is likely to be beneficial
The decision is always made on an individual basis.
Can My Child Choose Where They Live?
No. Children are not asked to make decisions about where they live or how much time they spend with each parent. Child Inclusive Mediation is not about asking children to choose between parents. The purpose is to help parents understand their child's experiences and perspectives. Parents remain responsible for making decisions about arrangements.
How Much Does Child Inclusive Mediation Cost?
The cost of Child Inclusive Mediation varies depending on the circumstances of the case. At Pax Mediation, we will explain any costs clearly before arrangements are made. If you are already participating in mediation, your mediator can discuss the likely costs and whether any funding options may be available. For an up-to-date quotation, please contact our team directly.
Is Legal Aid Available For Child Inclusive Mediation?
In some cases, yes. If you qualify for Legal Aid, funding may be available for mediation services, including discussions around Child Inclusive Mediation. Eligibility depends on your financial circumstances and the nature of your case. Our team can carry out a Legal Aid assessment and explain what funding may be available.
Is Child Inclusive Mediation Right For My Family?
Child Inclusive Mediation can be helpful where parents want to better understand their child's experiences and ensure their voice is considered during discussions. However, every family is different. The best way to explore whether Child Inclusive Mediation may be suitable is to speak with an experienced mediator.
